Roasted Betel Nuts Import Dispute: Scientific Uncertainty Leads to Conditional Release Under Strict Industrial Use Conditions

HC ruled on classification of imported roasted betel nuts, addressing inconsistent laboratory reports regarding human consumption fitness. After evaluating conflicting scientific assessments from multiple agencies, the court determined the consignment had deteriorated during repeated testing. The HC provisionally released the goods subject to Rs.5 lakhs security deposit, mandating the petitioner's undertaking to use the nuts exclusively for industrial purposes. The Customs Department was directed to issue a show cause notice and adjudicate the matter formally. The petition was disposed of, allowing conditional release of the consignment while preserving regulatory oversight.
