1998 (7) TMI 560 - HC - Companies Law

The petition filed under sections 433 and 434 of the Companies Act sought winding up of the respondent-company due to an unpaid amount of Rs. 6,39,923 with interest. The respondent agreed to pay Rs. 4 lakhs as principal but disputed the interest rate. The court ordered the respondent to deposit Rs. 5 lakhs within two months, allowing the petitioner to file a civil suit for recovery. The petitioner could withdraw Rs. 4 lakhs, with the balance to be decided by the civil court. Failure to comply would result in the petition being admitted.
